Distance Sales Agreement

The terms under which charging service is provided through the önizşarj mobile application.

This is a courtesy translation. In case of any discrepancy, the Turkish version prevails.

1. Parties

Seller: Asm Dekorasyon Mobilya Granit Mermer İnşaat Sanayi Ticaret Limited Şirketi ("ASM"), operating the electric vehicle charging network under the önizşarj brand.

Buyer: The consumer who registers in the önizşarj mobile application and receives charging service.

2. Subject

This agreement governs the electric vehicle charging service that the Buyer purchases electronically through the önizşarj mobile application, in accordance with Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

3. Service and Price

The service is the supply of electrical energy to the Buyer's vehicle at önizşarj AC and DC charging points. The price is calculated over the energy consumed during the session (kWh) at the tariff published on the pricing page and in the mobile application at the moment the session starts. All prices include VAT.

The tariff may change; the tariff valid at the moment the session starts applies to that session.

4. Payment

Payment is made by credit or debit card registered in the mobile application. The card is registered through 3D Secure verification. A temporary charge of TRY 1 is made at registration to verify the card; this amount is refunded once verification completes.

At the start of each session a pre-authorisation is taken to confirm the amount is available. At the end of the session the amount corresponding to the energy consumed is collected and any unused part of the pre-authorisation is released. Where the total exceeds the pre-authorised amount, the excess is collected separately from the registered card.

Payment may be made by one of the following methods, as determined by the Seller:

  • Post-use payment: automatic collection from the registered card at the end of the session.
  • Prepaid balance: deduction from a balance loaded in advance.
  • Package: use within the limits of a package purchased in advance.

A charging session may be started from the mobile application or, where one has been issued to the Buyer, with an RFID membership card. The receipt is made available in the application.

5. Performance

The service is performed instantly, at the moment the charging session starts and for as long as it continues. There is no separate delivery period.

6. Right of Withdrawal

Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal does not apply to services performed instantly in the electronic environment and to services whose performance has begun with the consumer's consent. Since the charging service is performed instantly upon the Buyer's own initiation of the session, there is no right of withdrawal for a completed charging session.

7. Buyer's Obligations

The Buyer undertakes to use the charging equipment in accordance with its instructions, not to damage it, to keep the vehicle and cable safe during the session, and to comply with the rules of the location where the station is situated.

8. Disputes

Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence or at the Seller's domicile are competent, within the monetary limits announced each year by the Ministry of Trade.

9. Entry into Force

The Buyer is deemed to have accepted this agreement by approving it electronically in the mobile application before starting a charging session.
